Terms & Conditions

Please read these Terms & Conditions ("Terms") carefully before using terrabath.com or placing an order. These Terms form a binding agreement between you and Terra Bath & Body. Nothing in these Terms limits your rights under Ontario's Consumer Protection Act, 2002 ("CPA") or other applicable Canadian law.
1. Who we are
"Terra," "we," "us," and "our" refer to Terra Bath & Body, a sole proprietorship operating in Ontario, Canada.

"You" means the person browsing the site or placing an order. By accessing the site, creating an account, or completing a purchase you confirm that you have read, understood, and accepted these Terms.
2. Eligibility
You must be at least 18 years of age (the age of majority in Ontario) to place an order or hold an account. Minors may use the site only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on the minor's behalf.
3. Account responsibilities
You are responsible for keeping your login credentials confidential and for all activity carried out through your account. Notify us at hello@terrabath.com immediately if you suspect unauthorised access. We may suspend or close accounts used in breach of these Terms or applicable law, on reasonable notice where practical.
4. Product information and pricing
We make reasonable efforts to describe and price every product accurately, including ingredient lists, sizes, weights, and photographs. Colours and finishes may vary slightly from screen to product because each batch is handcrafted in small quantities.
- All prices are shown in Canadian dollars (CAD) unless stated otherwise.
- Applicable taxes — including 13% HST for Ontario residents — and shipping charges are itemised separately at checkout before you confirm your order.
- You will receive an opportunity to review and correct your order, including the itemised list of prices, taxes, shipping, and delivery details, before clicking "Place Order."
- If a price or stock error is discovered after an order is placed, we will contact you to confirm or cancel the order before charging your payment method, or — if payment was already taken — refund the difference promptly.
5. Forming the contract (Internet Agreements)
An order placed on the site is an offer to purchase. The contract is formed when we send you an order confirmation email. We will deliver a written copy of the agreement (your order confirmation including all required disclosures) to you within 15 days of the order, as required by section 39 of the CPA. If you do not receive it, please contact us so we can resend it.
Your CPA right to cancel applies in two situations:
- You may cancel within 7 days after receiving your written copy of the agreement if we failed to disclose required information or to give you an express opportunity to accept, decline, or correct errors before placing the order.
- You may cancel within 30 days if we do not deliver the goods within 30 days of the agreed delivery date (or, if no date was agreed, 30 days from the order date).
6. Payments
Payments are processed by Stripe. We do not store full credit-card numbers on our servers. By submitting payment details you authorise us to charge the total shown at checkout, including taxes and shipping. Subscriptions are charged automatically on each renewal date until cancelled from your account dashboard.
7. Shipping and risk of loss
Orders are fulfilled from our Greater Toronto Area studio in Ajax, Ontario through Stallion Express. Title and risk of loss in physical goods pass to you when the carrier accepts the package — however, if a shipment is lost, damaged, or delivered incorrectly, we will work with you on a remedy under our Returns policy. Tracking and proof of delivery are provided by the carrier. Full delivery times, rates, and lost-package procedures are set out in our Shipping policy.
8. Returns, refunds, and cancellations
Our standard return, refund, exchange, and subscription-cancellation procedures are set out in our Returns & Refunds policy, which forms part of these Terms. Those procedures are in addition to, and do not replace, your statutory rights under the CPA.
9. Training courses and digital content
Course access is granted to the original purchaser only and may not be shared, resold, or transferred. Course videos, recipes, workbooks, and other materials are licensed to you for personal, non-commercial use; recording, redistributing, or republishing them is prohibited. Course-specific refund terms are set out in the Returns policy.
10. Intellectual property
All product photography, written content, course videos, recipes, illustrations, logos, and the Terra Bath & Body name and marks are owned by Terra Bath & Body or licensed to it and are protected by Canadian and international copyright and trademark law. Personal, non-commercial use is welcome. Any commercial use, reproduction, or republication requires our prior written consent.
11. Acceptable use
You agree not to use the site to:
- break any law or infringe anyone's rights, including intellectual property rights;
- upload or transmit viruses, malware, or other harmful code;
- scrape, harvest, or republish site content without permission;
- interfere with the operation, security, or integrity of the site or any user's experience;
- impersonate any person or misrepresent your affiliation with any person or organisation.
12. Statutory warranties and consumer rights
Our products are sold subject to the implied conditions and warranties under Ontario's Sale of Goods Act, the CPA, and other applicable consumer-protection legislation, including the implied warranty that goods are of merchantable quality and reasonably fit for the purpose disclosed at the time of sale. These statutory warranties cannot be waived, and nothing in these Terms is intended to do so.
Beyond these statutory warranties, products are provided on an "as is" basis. Skincare results are individual and may vary; perform a patch test before first use if you have sensitive skin or known allergies.
13. Free maker tools
Our cold-process soap calculator and related free tools provide educational estimates only. You are responsible for verifying all ingredient weights on a suitable scale, handling sodium hydroxide with appropriate protective equipment, and working in a ventilated area. We do not guarantee that calculator output is complete, current, or error-free.
14. Limitation of liability
Subject to section 12 and to the extent permitted by law, our total aggregate liability arising out of or relating to a purchase is limited to the amount you paid for the product or course that gave rise to the claim. We are not liable for indirect, incidental, consequential, or punitive losses (such as loss of profit, loss of opportunity, or loss of data). Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under the CPA, the Sale of Goods Act, or any other applicable law.
15. Indemnification
You agree to indemnify and hold Terra Bath & Body harmless from claims and reasonable costs arising out of your breach of these Terms, your misuse of the site, or your infringement of another person's rights — except to the extent caused by our own negligence or wilful misconduct.
16. Third-party links and content
The site may contain links to third-party websites (for example, articles, recipes, social-media accounts). We do not control those sites and are not responsible for their content, products, or privacy practices.
17. Force majeure
We are not liable for delay or failure to perform caused by events outside our reasonable control, including natural disasters, public-health emergencies, government action, postal or courier disruptions, supplier failures, or interruption of utilities or telecommunications. We will use reasonable efforts to notify you of significant delays and to perform once the event ends.
18. Privacy
Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
19. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above tells you when. Material changes will be highlighted on the homepage for at least 14 days. Your continued use of the site after the effective date constitutes acceptance of the updated Terms; orders already placed remain governed by the version in effect when you placed them.
20. Governing law and dispute resolution
These Terms and any dispute arising out of them are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. The Ontario Superior Court of Justice has non-exclusive jurisdiction. Nothing in these Terms removes a consumer's right to bring a proceeding in the consumer's home jurisdiction or to participate in a class action under the CPA.

21. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy, Returns policy, and Shipping policy, form the entire agreement between you and us regarding your use of the site and supersede any prior understandings.
